I don’t think this is a realistic reading of the facts.

“Not guilty” also does not imply winning. All it means is you aren’t giving up yet. Maybe that’s because you have some good cards to play, maybe it’s because you’re waiting to see everything they have, maybe it’s taking time to come to terms with the fact that you’re going to prison for most of your life.
