Even if people are literally constantly wandering into the street in a blind stupor (they aren’t, I’ve been outside), the responsibility would be on the driver to be aware of their surroundings as they drive.
If you are blind to the world with your nose stuck in a phone, and unexpectedly wonder off the sidewalk into the path of a bus, you die and it’s 100% your own fault.
